EPFO sets 20-day deadline for PF and pension claims, with a 12% penalty for Commissioner who miss it

India's retirement fund body has introduced enforceable deadlines for settling provident fund, pension and insurance claims under three new schemes notified by the Ministry of Labour and Employment in late June 2026.

The Employees' Provident Funds Scheme, 2026, Employees' Pension Scheme, 2026 and Employees' Deposit-Linked Insurance Scheme, 2026 replace legacy frameworks dating back to 1952 and 1995. Together, they mandate that EPFO settle any complete claim within 20 days of receipt. Fully compliant PF withdrawal claims, where KYC details, Aadhaar-linked UAN and bank information are all updated, are expected to clear in as little as three days through automated processing.

The sharper change is on accountability. If a Commissioner fails to settle a valid claim within the stipulated period without sufficient cause, penal interest at 12% per annum is chargeable on the delayed amount and that amount is recoverable from the official's salary. Earlier rules tied the penalty rate to the annually declared EPF interest rate; the new framework fixes it at 12%, making the cost of delay uniform and predictable.

If documents are missing, EPFO must inform the claimant of the deficiency within the same 20-day window, removing the scope for indefinite procedural silence that has historically stalled claims.

Contribution rates remain unchanged: employees and employers each continue to contribute 12% of basic wages. The pension calculation formula is also unaffected for existing members.

Members whose claims run past the deadline can file a grievance through the EPFiGMS portal at epfigms.gov.in. The portal allows members, pensioners and employers to register complaints, attach supporting documents and track status online using a registration number. If a complaint remains unresolved, a reminder can be sent through the portal directly to the assigned office, or the matter can be escalated to the Regional PF Commissioner.
